Exempt Resolution No. 4,771 requiring producers of certain priority products to declare the quantities placed on the market

On July 15, 2025, the Ministry of the Environment (“MMA“) issued Exempt Resolution No. 4,771, which requires producers of certain priority products to declare the quantities introduced into the domestic market during the year 2024, expressed in the corresponding unit of measurement, as the case may be.

This would apply to producers of lubricating oils, electric and electronic devices, batteries, batteries, wheelchairs, textiles, among others, that have introduced less than three hundred kilograms to the market, reusable containers, and containers belonging to the “others” category, provided that they do not qualify as micro-enterprises according to Law No. 20,416.

The declaration must be submitted no later than September 15, 2025, through the PRTR Single Window website, by accessing the website http://vu.mma.gob.cl, specifically the sectorial system REP-Producer, having previously subscribed to said platform as producers of priority products.

Producers adhered to a management system associated with priority pneumatic and/or packaging products shall comply with the requirement through such system, but only with respect to the categories and subcategories of the priority product that are not subject to targets or extended producer responsibility. Compliance with this information requirement shall be made through the management system to which the producer is adhered, but only with respect to the priority product it operates.

This requirement is part of the REP Law, which establishes the legal framework for waste management, extended producer responsibility and the promotion of recycling. Its objective is clear: to reduce waste generation and move towards a country that reuses, recycles and recovers, protecting the health of people and the environment.
