On February 7, 2026, Law No. 21,797 was published in the Official Gazette, amending various legal texts.
Among them, the most important amendments consider the following:
Traffic Law
• It states that a sworn statement must be provided to certify that the driver has not been diagnosed with or is not aware of suffering from any of the diseases that disqualify or restrict driving.
• It stipulates that vehicles used for transporting people, cargo, collective transportation, or vehicles with characteristics that make it impossible to see behind them from the inside, must have two conventional external side mirrors or cameras with monitors, or other devices that perform the same function as a side mirror, which provide information about the driver’s indirect field of vision.
• In vehicles that require a Class C license to drive, the passenger must be at least twelve years old, have their feet resting on the side footrests of the motorcycle or vehicle, and under no circumstances may they sit between the driver and the handlebars of the vehicle.
Labor Code (Art. 66)
• Establishes that the worker shall enjoy labor immunity for a period of one month from the date of the respective death.
• In the case of workers whose employment contracts are for a fixed term, or for a specific project or service, the immunity established in this article shall remain in force for the same period or until the end of said contract. This means that if the duration of the contract or the work is longer than one month, employment protection shall be extended for the entire duration of the fixed-term or specific-task employment contract.
• The expiration of the term or the end of the work during the month of employment protection does not allow for dismissal, and it is necessary to request the removal of the worker’s protection.
